Fishy lost from what I heard.... And to think I was going to tell him not to take his bike (because I wanted him to change the front tire on his) and take mine instead... But for some reason I decided to take my bike (I normally only ride to work on fridays due to dress code) so I took the mesh jacket which left james with my heavy textile jacket (lucky him) He can fill you guys in on the details later

hey was sup guys.... yeah i lost to the bmw...here is what happen i was riding to work and there was mild traffic, i was crusing at a steady speed...as i approach the opening of the carpool lane on the 55 fwy here in so cali this white bmw decide to switch lane toward me without signaling...i was in plain view to all the driver. next thing you know i see her coming toward me, then from there i get hit by the front end of her car..i held on to the bike for couple sec till i was knock off of it... the bike skid 1 way and i skid the other way, i probably skid about 20 feet till i came to a stop....man glad i had the gear on...

oooo and fellow rider saw me go down and stop and assist me...bike is still rideable, still run on flaw that i could tell is scratches to the lower fairing, crank casing, and the portion of the exhaust....thank god i had slider on the bike who know what other damage would be done without it....i was in shock for a couple min...the lady in the bmw didnt want to come out and give me her info, her bf had to come out and talk to me...so we exchange info and i told him we will be in contact si know im here at home ccleaning up my cut and bruise i had on right leg...man im sore as fuck now

You didn't get a police report? and it was her fault? My friend that was stupid on your part. Her insurance company can basically tell you to take a walk. If it's someone else's fault ALWAYS get a police report.

Its my bike so I'm going to have chick pay for the damages and fishy gona lucky out and get a new exhaust system (since dealer doesn't sell just the muffler hahah and I will be getting oem replacement prices) most new plastics and a new paint job since its not the oem color and I don't have the color code they couldn't match just those pieces.. I'm going to be asking for money to replace my jacket which is tore up nowand replace what ever else is messed up on the bike including his medical bills.. He didn't tell me the bitch wouldn't even get out of the car I would have taken off just to come cuss that bitch out (I was already at work about 15 minutes away)

But you you don't always need a police report and in most cases in cali unless someone is seriously hurt they straight out tell you that... They can't be bothered to help you unless that you know they too busy passing out speeding tickets and stuff

damn man that blows..again, at least you walked away unscathed for the most part. so her front bumper tapped your rear/side? thats some scary shit to happen on the freeway..all that'd be going thru my head is "please dont get ran over" and FYI, you can still file a police report..did ANY cops come to the scene? and yeah in cali a police report is not required unless damages are over $1,000 or bodily injuries occured.

Lyte, Your friend should have called the police. I was with a friend when he got hit by a car. He was OK and the bike wasn't that damaged, but we still called the LAPD. They came and found out that the car driver was drunk. Now everyhting else is much easier... Good luck and be safe!

man i woulda had the police come in. I dunno man, she might be able to get away from it. Its cali. Lane splitting is legal, but i heard if somethig happens to you while your lane splitting, you are liable. She can say you were lane splitting. That bitch my try to pull a jack move. Just watch out. From what i've seen and learn in the past, a police report is very very important. I know friends who've gotten into accidents and it was there fault and got away with it cause there was no police report.

the chick called her dad and told her dad she got into an accident (she didn't tell her dad she almost killed someone on a bike) so the dad went tot he insurance company and told them she got in an accident but had no information... so the chick was waiting all day for me to call her.. i left a message and she called me back with in 10 minutes i think... got all the information.. told her the story said the claims adjuster should be contacting me in 48 hours to make an appointment to come look at the bike/ my gear etc... she kept asking if james was okay... did he need to see a doctor ...if he say a doctor then to keep the bills so we could get reimb she also gacked when i told her the chick refused to get out of the car after she hit him.. im already looking for a new jacket and full yosh system since the muffler has to be replaced

get a law firm that works on a system where you only pay a percentage of your settlement (I forget what this deal is called) my buddy got hit by a car as a pedestrian and the ins co had to fork over another few grand... imho fuck her, :2hard and maybe she'll tell her friends to look out on the roads! and I certainly don't have any problem with making an ins co pay :2hard ... I'll more than return it to them in the long run, for sure...

so the chicks insurance company called me and they are taking total responcibility as the girl admitted blaim in the accident... and i believe her boyfriend was quoted as saying "if she just looked over her shoulders she would have seen him" they asked if i had already taken the bike in for repairs.. and they couldn't get me a replacement bike (i quickly found out she ment as in a rental) but i told her don't worry about it cause i don't need a rental... so where should i bring the bike for an estimate? although the chick did lie and said he had full controll of the bike (as in his ass didn't do a slip and slide down the fwy... im sure that was for her fathers benifit)

1) she has money, so it's not going to put her out of food and shelter to pay a bit more for that bimmer's insurance... (otherwise I might not do this) 2) she made a mistake that very easily could have killed someone and didn't even take full responsibility.. 3) there are a lot of positive things that could happen if you make it hurt a little more... I'm not wholly vindictive, but I do feel that there isn't anything wrong with making this sting a bit. Again, I'd really like her to tell her friend up here in Seattle that she (or her insurance company) had to fork over 5g's on top of replacing the bike because she forgot to look over her shoulder... maybe her friend will remember that... and not kill me. :hmmm:

the car is insured under her dad so she not paying shit... Im going to take the bike to get the estimate some time next week as soon as i find a place that does that.... now that i am thinking about it i don't know who does that nor do i think i want to ride the bike with the front tire looking the way it does (the rubber got worn WAY down at an across angle from the sliding i believe...i might call them back and have them arranged to have it towed to the place and towed back

They don't have some that comes out and does estimates? When i got hit in my car the insurance company had a person that came out and made the estimate right at the house. Of course he was a little off, but they still took care of it.

All state it seems doesn't have motorcycles in their system so they don't know its value .. So they told me take it some place call them then their adjuster will go out and look at the estimate.. And while I was calling around to places everyone wants quite a bit of change to write the estimate and they want to keep the bike for up to 1 week just to write the estimate ranging from $75 to $180.

Naw I dun want to involve my insurance company.. The little rich girlss insurance is picking up the tab for everything I'm calling the adjuster monday ask them what they want to do.. Rent me a truck and a dolly to take it there or pay out the ass for the tow truck to take it back and forth

So i made an appointment to drop off the bike for an estimate on saturda. dude supose to take a look at it on monday at berts mega mall. Then i called the claims chick to tell her where the bike is going to be so they can have their just adjuster go look at the bike with berts people. Then i told her i might have the bike towed out there will be expensive could be $300 from my house to there.. and that berts was going charge $180 for the estimate the chick nearly hit the roof... she couldn't believe they would charge for an estimate.. hahaha she thinks they will be able work out a deal with berts

Charge for an estimate? Never heard of that down here in Alabama. I could understand paying for an estimate if it were going to be an above average estimate maybe, otherwise that sucks. ofcourse its not coming out of your pocket either, but that would suck if that $180 pushed your claim just above the point so that your premium goes up.

God damn berts parts estimate is 5270.24! And the bike still has to be repainted and they have to pay to replace my gear, other out of pocket expense for shit for that bike to get it over to berts. not to mention pay james for her pain and suffering

Goodluck on a quick reply from the insurance. When i got hit in my car they where pretty quick it was just the car dealership that took there freakin time. It took them over a month to fix my car. Of course i had a rental the whole time. They also gave me 2 grand for pain and suffering. All i had was a bump on my head. Your friend should probably get alot more then that.

SO the ins company called me back today.... the repair cost are 95% of the value of the bike so they are considering it a total loss... Berts is charging them $10 a day storage fee (which they never mentioned to me ) so she wanted me to call berts and have them release the bike to them... Which i of course promptly told them ijust recently paid for that bike and had not even had it for a month 1/2. She said it was not a problem for me to purchase the bike back and i could discuss that with the totally loss department. And since i wanted the bike back i could just take it back to my house. She also told me i could discuss with him the cost of my gear and what not

So correct me if i am wrong someone... they said the bike repairs (5270.24) is 95% of what they consider the retail value of my bike is... which makes the retail value of the bike 5547.62 subtract the repair cost of 5270.24 makes the bike value now 277.38 as it stands (pretty badly damaged as she said) haha does that mean i get to buy that bitch back for 277.38??? damn that would be cool as hell if so!

Okay so the newest update.. State farms total loss department contacted me today The say the value of the bike is 5520.00 427.80 tax and license and 66 I paid for registration. So which makes their settlement offer to me at 6013.80... They will sell me the bike back at for 1685.33 making my total settlement 4015.86... At that point I kindly reminded her that my gear was damaged in the accident and they also needed to reimbus me for those items as well as towing etc... Which should total up to another 500-700 Now considering they said repairs would cost 95% of the value then how do they think they can charge me $2k to buy it back from them
