NY:unlicensed supervision ticket

got pulled over by myself on a permit in port jeff last night and got an unlicensed supervision ticket...first time ever receiving a ticket and i dont know what to expect. i asked the cop if this is going to give me points and he confidently said NO it wont....basically asking if you guys think he was bs'ing me? i explained EXTREMLY politely that my licensed rider had to leave early and i just trying to get a bit of riding experience before my road test at the end of the month. i had all valid regi,insurance, and inspection along with my uncles NYS investigators card...didnt matter he was pretty much set to get me....said he saw me pull into town, watched me go into the restaurant, walk around with my friend, and go back to my bike...straight profiling right there anyway, im just wondering what you guys think is going to happen with this....im only 18 so i REALLY REALLLLYY could do without an increase in insurance. once again, the officer said he did not know cost but told me there would be no points. i dont mind paying a fee but all i hear is horror stories of insurance going up hundreds and even thousands after a ticket. also, my road test is before the court date so i will have a valid license by then. i'm just worried that im going to show up to court and be told that the ticket carries points when i was told that it wouldnt. opinions?

Damn you should know better then to hit up PJ by yourself if your not legit. They look to get us, good luck with the ticket.

i know man my rider had to leave early and i couldnt find anyone to pair up with on the way out till i hit 25....figured i could make it but obviously not all i wanna know is if this is a moving violation or not...i got some people saying yea some saying no

thats what i like to hear,,, im hoping thats the case because a non-mover *usually* shouldnt effect insurance rates correct? thanks alot for the imput

call the da's office and find out or drivers center, you could probably even find out searching the internet. as for the cop, thats why some of em have a bad name. why exactly did he pull you over, speeding, wreckless driving? as soon as cops see a sport bike the lock right on to us until we do somethin. the cops in this town are fuckin a-holes towards "crotch rockets" they like to call it. they are fuckin commies and hypocrits. i have friends that are cops that are cool as hell but there are some n00bs in this town on a fuckin power trip.

that really sucks...i guess my only chance is to get my license, plead not guilty, and hopefully get it dropped to a non-moving violation. DAMNIT.DAMNIT.DAMNIT. i wish the cop wouldve just told me it's a point ticket so it didnt cause so much confusion edit:he pulled me over because he ran the plate and saw it said permit HOWEVER he passed cars over the double yellow and damn near rammed into my rear tire to get to that point for NO REASON AT ALL...i was doing 30 in a 35 with traffic in front of me...obeying any and all laws. he was dead set on getting me for something

^^? how do you know for sure hammer? not sayin your wrong but says you do if ya red that link.... hey ny450 find out for sure from an insurance company but dont call yours. do some research before you go to court...i dont know about ny state but in pa it says on your ticket if there will be points on your license.. plus i have gotten many tickets and pleaded not guilty, took in front of the da and got out of gettin points against me and just paid the fine. if your that worried about and the cop was passing on double lines without the lights goin and bleepin his siren and almost took you out like you were a convict, i would def fight. he sounds like a real power tripper.

Why did he run your plate if you weren't doing nothing wrong? I hate shit like that. That is sport bike profiling!!! Maybe in court they will reduce it if you have your liscense by then.

Why the hell was he hawking you as soon as you got into town??:hmmm: Harassment comes to mind? i would talk to a lawyer and see what can be done. Just my .02

my friend wasnt on a bike, i followed him down in his car. the area is a strip style main street where everyone hangs out and with all of the traffic/cars on the side of the road/people its basically am idle in and idle out type area...no way i couldve sped in or done anything to piss the cop off...i just coasted in, parked, and walked away... from what i hear i guess suffolk cops are just trying to make a statement that they are going to be strict on bikes this season(what else is new)...although i obviously shouldnt have been alone on a permit, i 100% did NOTHING to break the law or attract attention. just the fact that i was solo on a sportbike was enough for the cop to get behind me at the first red light...all i can say is hopefully he wasn't bs'ing and hammer71 is right about it being a non-mover...i will gladly pay the fine...i will have my M endorsement and be worry free.... regarding the ticket....do i still have to mail it in if there is no fine written? i told the cop it was my first and asked what i needed to do and all he said was show up at the court date, nothing about mailing it in. "i dont know what the fine will be, shouldnt be much just show up at court on jun.24th at 7pm"

As the DMV book states you technically had a licensed driver with you (friend in car). As far as ticket, mail it in Not Guilty (space provided on back of ticket), they, (the Court), will send you a letter with a court date and time. Arrive early and speak with the cop if he is there (most will plea the original offense to a lesser charge). If he isn't there bring this to the judges attention and ask to have the case dismissed as you have a right to question your accuser. Still looking for the sheet I have with the point able offenses but I am certain (as are my co-workers) no Points. Any other questions PM me.

the friend in the car was not involved...he did not have a m/c license anyway and was not pulled over with me. it was just the cop and i, but still told me there would be no points. i will mail the ticket in not guilty and talk to the cop @ the court date....if it is a moving violation i will ask why he said it wouldnt have points and try to plea to a non-mover.... my friends dad was actually down there with us that night and he has a bike license...just wasnt there at the time of the pull-over so i doubt i could use that to my advantage in any way. appreciate the help

i just called the court and the lady also told me no points. both the cop and court lady are saying its a non-mover so hopefully they are right. i mailed it in not-guilty this morning (just in case it does happen to carry points) and when i show up to court, i will gladly pay the small fine if it is indeed a non-mover. i will show the judge my license, tell him my friends dad with the bike license was waiting for me up the road, and just go from there i guess. i wouldve just plead guilty and payed but with everyone giving me different answers on it if carried points or not, i didnt to be safe thanks for all the help so far:thumbup:

Hmm, never heard of such a ticket :). I was pulled over a few times with my permit (because my inspection sticker wasn't visible... it was in the factory location where the dealership had put it *on a brand new bike*). Not one of the times did the cop say anything about the permit, even at midnight. When I gave him my permit he looked at it funny and asked if I had a license. I gave him my Class-C license and he said OK. Came back gave me all the stuff back and that was it. I think cops around here just aren't as hard-assed, or perhaps its different in PA?

that really bites man. Every agency in NY is going to hammer down on bikers this summer so if you do not have a license get one sooner rather than later. I am scheduled for my road test on june 5th.

I think cops around here just aren't as hard-assed, or perhaps its different in PA? you either had cool cops that didnt care or cops that dont know shit about the laws on m-class permits. in pa you are not allowed (depends on if you have a c-class license for some) passengers unless its an instructor, riding after dark, or leaving the state,Pennsylvania law requires that any person who operates a motorcycle must wear protective headgear unless he or she is over 21 years of age and has had a motorcycle (Class M) license for a minimum of two years or is over 21 years of age and has completed a motorcycle safety course approved by PennDOT

Most cops in NYC limits, have the a-hole mentality. Guess it's dealing with so many non cop a-holes, who knows... Good luck with your ticket, in my years of fighting the laws, the laws ALWAYS win. What I usually do, is hold out and reschedule the appearence date, in hopes the cop doesnt show then it's an automatic dismissal but since they make OT on this, most show. If you were riding around alone & got pulled over, correct me if I'm wrong doesnt that make it a moving violation? Not sure if it's points or not, probly not if you called the court clerk. You'll go through the hassle of going to court, and probably be fined. Check with DMV as to what are "pointable" offenses, dont think riding around un-supervised is one of them.

no idea. i went to the judge, plead guilty with an explanation...he looked at the ticket with a WTF face and was like if i were you id plead not guilty...this is a defective ticket. have a meeting with the da......actually you know what, if its ok with you im going to dismiss it right now. i said hmmm that sounds ok to me, thanks:thumbup: i smiled the whole ride home

Either the cop filled out something wrong, like the violation code and sub-division, Or left something out. If the cop pulls a no show they dismiss the ticket,usually... The reason the cops are such asses in Port Jeff, the stunters stunt,Guys speed, Wherever and with no concern for anyone's safety. Not every does this, but it does profile.. No I'm not a cop, but I've seen the results.. Ever open a shield to check on a guy, & his brains run out? Its what happens when a rider smacks the side of a suv at a 100.. FD is there to do a washdown.... It sucks...
