TheBigO87 07-31-2008, 04:23 PM My friend just told me that there is supposedly a law stating that if a motorcycle is traveling above 90 mph that the cops are not authorized by law to chase them. He said that it was because two cops have died and one motorcyclist has die. He also said he searched it online and found it, but when i search i can't find any law that says this. Has anyone heard about this?
h2opolo25 07-31-2008, 06:25 PM If this were true in CA then nobody on a bike would ever get pulled over. I really doubt it's true.
slodsm 07-31-2008, 08:32 PM I will do some digging and see if I can find out. There are similar laws in other places but they aren't state laws. When I lived in NC (just moved back to Tx), in Wilson NC and Jacksonville NC, City cops wouldn't chase you if you were doing in excess of 80 mph, they just radio'd in a description and kept going due to deaths from riders trying to evade and a lawsuit that was filed against the city by a disgruntled parent whos kid died running from the cops.
I don't care either way though, I do the speed limit because pavement hurts and tickets are expensive. I save the throttle for the track.
If you see red and blue lights flashing and you are doing 90+, Pull over and take responsibilty for your actions. Dont risk your own life and those around just because you make poor choices.
aroad02 08-02-2008, 06:38 AM Dallas PD (note Dallas PD) has a some type of no chase policy for every vehicle other than that I havent heard or seen anything.
Either way dont risk it just pull over and live to ride another day!!!

CBS 11 News has learned that patrol car video from that night raises questions about whether the traffic stop was a chase. If it was, it might have violated the new pursuit policy, adopted this summer, which requires officers to have - "probable cause to believe that a felony involving the use or threat of physical force or violence has been, or is about to be committed."

TheBigO87 08-02-2008, 09:57 AM i'm not posting the question because i plan on running from the cops. I drive back and forth between austin and dallas quite often at 85-90 mph and i have yet to get a ticket and i was wondering if this is the reason why.
Monedogg 08-02-2008, 07:21 PM Yeah i dont know about that one cause out here on the east coast they come after you hell i was in MD leaving from the track and it was maybe like 11 almost 12 and my boys was in the car and i was on the bike and he said after i rolled 100+ on the Highway he said the boys was coming after me the only thing was they dont turn there lights on out here till they get ya but i got off the highway before he could get to me so be safe out there
haarnasty 08-07-2008, 04:00 PM actually that might just be true. maybe its just luck or somthing but everytime i fly by a cop, they just sorta waive. my neighbor is about to become an officer (i know, how unfortunate) and he said at least in Tyler, Tx (where i live) there is a city ordinance that police are not instructed to give pursuit for the very reason u stated. he told me the reasoning is that a traffic ticket is not worth risking a life or two. and besides the pd here doesnt have heli's so theres no way they can catch u. hang a right on a back road and we'll see ya. now im not certain if thats how the actual law is written, however as each day passes with more encounters of flying by cops that wont do anything it becomes more evident.

If you are doing 90 consistantly on 35 then you are just lucky you haven't been pulled over yet. The faster traffic on that road is usually going 80. If 85 is what is indicated on your speedo, than you are doing closer to 80 in reality so that is probably the explaination.
TheBigO87 08-13-2008, 10:30 PM Well i ended up doing ALOT more research about it and could only find that Dallas PD has this law for sure. I guess i just get lucky through the rest of the cities i speed through on my way to and from dallas.
dgrobe2112 08-14-2008, 12:40 PM Waco has a no chase policy also.. they will pursue, but only up to a certain speed.. if it goes over that.. then they stop pursuit.. due to accidents.. and deaths.. not just bikes.. in cars too..
GSXR750LUVER 08-14-2008, 02:43 PM i have a cop that is my next door neighbor in killeen texas and i have talked to him about the 90+ law and in central texas they have that law they will not persue anything after 90 because of the accidents and deaths that happen when they do

Yeah dallas PD has that law BUT BELIEVE ME, they dont follow it. Ive never been caught running when i used to do it nightly, speacilly thursdays leaving sonics, but i know guys that were simply speeding, pull over and get their asses BEAT DOWN.
BlackEx 08-17-2008, 06:10 PM I asked a San Antonio officer about this. He said that here it is up to the shift supervisor. If it's the middle of the night, they'll probably get the green light to pursue when they call it in. If it's rush hour, the shift supervisor will usually call it off immediately. He said this applies to all vehicles, not just bikes. He also said that if at all possible they'll get your plate number before turning on the lights and siren if they feel there's a chance you'll run. That way if the chase is called off they'll just come to your house and arrest you.
I'm inclined to believe the rules are different in each county and there is no set guideline throughout the state.
splymale 08-19-2008, 03:11 PM I heard the same thing but I dont know if its true. I dont think I'm gonna try it to find out though.
slodsm 08-21-2008, 10:00 PM I was getting diesel Monday and BS'ing with a state trooper at the gas station. He was telling me about 30 days ago he was in a 5 county chase involving a woman in a caddy running in excess of 120 mph.
When they got her stopped, the freaking idiot had ALL THREE of her children in the back of the car, she went away on 300k bail for felony child endangerment plus many other charges.
This sounded a little ludicris so I came home and looked it up (didn't see it on the news, though maybe he was BSing me to sound cool, they will do that just like anyone else from time to time) and it was in fact a true story.
That leads me to believe it varies from city to city and country to county because they damn sure chased this woman from Kilgore Tx to Palestine Tx before getting her stopped.

I think most of them round here is up to the officer in chase.. friend of mine here ran from the cops, in robinson, tx. they started after him, for being in a wheelie. he took off, he was doing 130 plus he said.. it was at night, and no traffic, out on hwy77, then he turned towards Eddy, and he ended up giving up and just pulled over.
But they had the road blocked ahead, and officers from 3-4 different cities, and the sherrifs department all in persuit..
3k bond, for evasion, or attempt or something like that..

WE were riding throught traffic, there was alot of traffic for the roads to be block where i was.I guess it depends on the road conditions and the officers..
SPOONJP 09-09-2008, 07:42 PM alright heres the deal i had a friend haul ass down i35 sat night just joy riding, he passed me while i was in the car he was prob going at least 140mph. any how about 20sec later 3 police crusiers passed me chasing him, he decided loop around on an exit and go home, but as he got to the top of the bridge he saw the cops down the highway. knowing that it was for him he then booked down to the highway to get some distance, but there was alot of water runoff at the bottom of the bridge and crashed at about 30mph. he techniclly didnt know he was even being chased until the top of the bridge. weel lets just say the cops finally caught up after he had time to remove his helmet and call me to say "well dude im going to jail". as he went to remove his key they tackled him and arressted him for felony evaission. but that being said they will chase you though at least denton county, but still not sure about dallas county. :infrandom lets just say he wont attempt to run anymore considering he only got to really run for about 200ft:headshake

TheBigO87 09-13-2008, 11:44 AM Thanks for all the replies. from what we have all heard it seems to be on a city to city basis. And that police dept. with the busa is crazy and the second one i have heard of but the other one is not in texas. I bet the no chase law will be enforced much harder when a cop goes down on that busa.

But I do know for a fact that arlington will chase you too. I got a ticket 91 in a 60 last thursday. Cop said they got someone doing 128 that same night. I asked him..."do you even bother chasing someone going that fast" he said...yup...and we catch em too.

i know he was just blowin hot air.
I just recently found out something. When I was riding thursday and noticed the lights on the shoulder ahead, I looked at my speedo and it read 78, which is still speeding, but not 91.
Turns out...in arlington. 31mph over the speed limit is the MAXIMUM that you can be allowed to get deferred. But heres the catch. To get get deferred, your fine doubles....so...double 31mph and get deferred. Thats the MOST they can make off of a ticket...period. Even more than if you were going 120 (which you cannot get deferred for going 120).
So....seems ironic that the cop got me at exactly 91 when thats the maximum fine they can possibly give.
Im fighting the ticket cause there is no way in a group of 6 bikes, from 1004 feet that he can get a visual on MY bike and give me a citation for 91...I know I wasnt going 91.
Im getting dry cracked by the system

But if this guy was following me i would certainly stop.

antzgarcia 04-18-2009, 07:47 PM cops are not supposed to chase us motorcycles any way in Texas they are supposed to radio a head and set up a block or follow with a hellocopter because the chances of the biker getting hurt trying to go faster to get away increase with a chase they want you to think you got away and I learned this from a cop friend.
yakitori 05-12-2009, 07:20 AM cant outrun a radio
radios only work if they know where you are.
Deception beats a radio any day.
you dont have to be super fast to get away, you have to be slick.....and know your streets.....and trick the cops into thinking you kept running, hit the backroads home...park the bike....change helmets/jackets...etc.....or just dont ride for the next couple of weeks at least.
but on the otherhand. GUYS>>>>>STOP RUNNING FROM THE COPS. please. seriously. Just ride smart. There is a time for going fast and a time for cruisin. Im tired of getting pulled over once a week and the cop using the excuse "We're just checking DOT stickers on people's helmets" to pull me over. And then end up asking me if I run?!.....NO...I DONT. And this is getting pulled over for NOTHING. Like.....going to the grocery store, got pulled over. NO TICKET....just a waste of my time and an excuse for a cop to look for a reason to hand me a citation.
Truth be told.....Majority of these kids that run from cops and ride fast......cant ride that good anyway. Anyone can go fast in a straight line.
You kids need to go to a track. Trust me.....its much more fun than riding the streets/highways. And if you do crash most likely you will walk away......not always the case in the streets. And who knows....maybe if you actually have a shred of talent, you can make something out of racing, and be someone instead of a punk that ruins it for everyone else that rides a sportbike.
