Newburgh - A stormville man was killed Monday when his motorcycle was hit by a car, according to the Newburgh town police dept.
James A. Caswell, 21, of Stormville, was riding west on Route 17K when a sedan driven by 88-year-old James H. Irving of New Windsor turned from the parking lot of the Neptune Diner and into Caswell's lane.
Caswell was thrown from the motorcycle on impact and suffered serious injuries. He was brought to St. Luke's Hospital in Newburgh, where he died a short time later.
Irving was treated for minor injuries at the scene. Irving was cited for failure to yield the right of way when he made the turn from the diner parking lot onto Route 17k.
James Andrew Caswell
STORMVILLE James Andrew Caswell, 21, a lifelong area resident, died Monday, July 11, 2005 at St. Luke's Hospital in Newburgh after injuries sustained in a motor vehicle accident. Mr. Caswell was a student at the Environmental Science and Forestry School at Syracuse University. He was a 2001 graduate of John Jay High School in Hopewell Junction. James was currently doing construction for Hillside Homes in Newburgh. As the starting goalie for the John Jay Soccer Team during his senior year, James helped lead the Patriots to winning the State Championship in 2000. He also participated in Club Soccer at Syracuse University where he was a member of the Cheerleading Squad for the Orangemen. Locally, he played in the East Fishkill Men's Softball League. Born July 12, 1983 in Newburgh, he was the son of Stephen M. Caswell of Stormville and Catherine McCoy of Norfolk, Va. In addition to his parents, he is also survived by his sister, Dana Caswell of Stormville; his grandparents, Blair and Margery Caswell of Florida; Alexander Fucito of Florida; and several aunts, uncles, cousins and extended family members. Calling hours will be 2-4 and 6-9 p.m., Thursday, at McHoul Funeral Home Inc., 895 Route 82, Hopewell Junction. Funeral services will be 11 a.m ., Friday, at the funeral home. Interment will follow at Wallkill Valley Cemetery in Walden. In lieu of flowers, memorial donations may be made to the James Caswell Fund for the John Jay Soccer Boosters, c/o Mr. Robert Seipp, 67 Seaman Rd., Stormville, NY 12582. AndyMoose 07-13-2005, 01:29 PM I watched my 78 year old grandmother pull a similar move today pulling on a four lane highway. Thank God nobody was there to hit her and my mother doesn't have the heart to take away her car. STUPID!!! Well we will all be that old one day. RIP with the ghost riders amigo! :headshake

timo769 07-13-2005, 06:37 PM yea that thing about the ticket pisses me off. once you reach a certain age like 70 you should be tested almost every year to see how you drive. I even worry about my grandfather behind the wheel of his car once in a while but the good thing is that he drives slower than anyone i know. i also just noticed this,to make matters worse James died the day before his birthday.

yes, no doubt it sucks. This just gives me that much more motivation for writing old people tickets! I see it every day when a older person completely blows a stop sign or pulls out into traffic accidentally. I actually use to be semi-understanding about it and gave them a speech about being more alert and cautious when driving. But every since a fellow biker was killed in my area by a elderly man I started trying to do something about it. I've actually written 3 tickets this week for various violation from elderly people. Nontheless I still give the ass chewing just as I would before, but also issue the ticket. Fellow officers laughed at me the other day when I turned in a ticket issued to a 78 year old man for running a stop sign. I explain to them just as I did the elderly man, If I can prevent one person from dieing or being seriously injured by one of these elderly people then I'll write all of them I can. I also filled out a retest form that is sent into the DMV and requires the individual to report to the DMV for a retest within 60 days of the issue date. Yes, and I to think that it should be mandintory for there to be a retest every couple years after a individual reaches the age of 70 or so.

And yes, its called an accident for a reason. There was no intent to kill the guy, although it could be considered negligence. I understand that accidents happen and everyone shouldnt go to jail for homicide just because they didnt see a car or bike in the blind spot, etc... If the old man werent charged with negligent homicide then its simply going to be up to the parents etc. to sue this guys ass in civil court. I hate it for the old bastard, but owell.

I'm european and where I come from, this old guy wouldn't walk away with just aticket. We have different opinion on this. As I see it, he killed that guy. Accidentaly but he did and he should pay more than the ticket. 20 years ago, my uncle accidentaly killed 2 people while there where crossing the street. The street was marked for crossing, there were a signs there too. It was his fault. He spent 2 years in prison. I felt sorry for him, but I think he deserved it and I think the old guy desereves same. I don't even know if I could live with that like that.
Anyway, I guess we come from different cultures and have different opinions.

pmhallum 07-15-2005, 08:51 PM While I feel the same way about little lenience tward the elderly or unaware drivers... in the case of senior citizens I understand the unwillingness of the state to take licences away. Understand that for many elderly people that can be a deathblow. Anyone can think of examples of retirees being lazy around the house only to die only a short way into the "golden years". Losing an essential means of transportation (and it is truly essential in many cases) can leave a person to rot in their home until they are carted to a nursing home and die there.
on the other hand.. fuck them and take them off the streets for my and your sake.

04StreetGSXR 07-15-2005, 09:51 PM ahhhhhhhhhhhhhhh i hate old people, not really but they are all so stubbern, my neighbors are old but in 60 perfectly capable of driving, now the man drives more like a teenager but hes been drivin longer than i have been alive i trust him, but man i am so totally for retests for eldely people, this kind of situationa always pisses me off, i feel for the old people, but some should never drive, sad to hear what happened to this guy, i think there should definitely be a retest for ALL people every couple years, not just elderly cuase there is still people younger that do not know how the hell to drive. driving cars and riding my bike means the world to me, if that was taken away i wouldnt know what to do, but cmon people when your old there is a time to stop. shit when i was getting my endorsement on my liscense there was an older black lady in there and she was renewing here liscense and she couldnt even read the two rows of letters, i hope she didnt get her liscense renwed, i could go on forever but def think everyone should have to retest every couple years. :damn: :damn:

toml71 07-17-2005, 03:44 AM Very sad to say the least for this guy. As I read the story from the first post and saw towards the end the driver was 88 years old it made me angry! The reason is when I was riding a couple years ago I can't tell you how many times an old timer almost took me out!! Hell even driving in my car its almost happen! No dis-respect to the older generation but something needs to be done to keep them and others safe.

I had some 60+ old lady 'MERGE' into my lane doing a left hand turn on a 50mph road.. To avoid being sideswiped I had to slip onto the emegerncy lane. And came about 1 foot from a nice big telephone pole.
At that moment and after numerous hours previously of playing RoadRash on my console I had this sudden urge to mount a steel pole to bike for quick access to beat the hell outta her car lol.

Same thing happened to me last week. cruising down the road in the right hand lane, when a woman, that had to be in her 70's, pulled out right in front of me!!! needless to say i pulled my first stoppie :lol: pulled up next to this woman and told her to get her kataracts checked.....then she gave me the bird :2hard believe that shit!!! People are always pulling out of parking lots and not LOOKING or cutting people off!!! :eek: The subject of elderly drivers is touchy. Some of them do not belong behind the wheel anymore. Before my father passed, I told him several times that he shouldn't be driving anymore and he would get pissed..............and say "I taught you how to drive".........and "I hope you can drive as well as me when you get my age". WE all will be OLD oneday and I hope we/I will know when it is time to stop driving. I hope to be riding until I cant walk no more!!! :D

Dude thats killer sweet .....I think the rightest thing to do ......I just wish there would be more like you out there looking out for us (RIDERS)....also other peeps on the road as well could be our kids in other cars even ......fuckin scary when you really think of it ..........RIP young brother I'm always so sorry to hear about these tragic events .....fuckin kills me ... :2hard those bad drivers
