Basically you can move them wherever. It's not going to hurt anything as long as the forks stay aligned. There is pros and cons to moving them, but you have a good deal of flexibility in where and how you position them.
I not sure if you are talking about the gap between your clipons and the triple or the height of the fork tube in the triple?
Yes you can lower the forks in the triple all the way to flush. Many (like me) prefer running them flush as it raises the bike and makes for quicker transitions. There are fork extension tubes available to lower them even further.
Make sure you also raise the back to balance the bike. A shim under the top shock mount is the common, cheap mod. I think it was a 5mm shim but double check that.

You don't move the upper clamp. The lower goes in with the steer tube and lower head bearing. Then the upper bearing goes on with the dust cover and jam nuts. Then the upper clamp goes on and has a nut that secures it down onto the jam nuts. The distance between the upper and lower clamps is therefore FIXED. You can then move the fork tube up or down in the clamps which adjusts geometry. Once your tubes are where you want them, you clamp on the bars.
Per the manual for my bike, the tube should be 5mm above the upper clamp.
The clipons my go flush to the clamp, but on OEM there's an alignment pin that may prevent it.
I think you are over thinking this. There really isn't anything "wrong" with anything in those pictures. It's a common mod to lower the front end a little. The answer to your original question, is yes, you can loosen the clip on and move it flush up to the triple... The big question is, does the other side look EXACTLY the same? If id does you don't have anything to worry about, if it isn't you need to adjust it so it is...
