Wheelie- Legal Question

Hypothetical: Somebody sees you doing a wheelie and writes down your plate number to call it in. What's the worst case scenario?

Trying to settle a bet/ friendly argument with a friend.

if the cop can get the person who called to make and sign a complaint i think he can give you a ticket at least. Thats what i was told unless the cop was bullshitting just to scare me, which is possible...

...but then everybody with a grudge against a sportbiker could file false complaints.

My argument is that you can't give a ticket to somebody based on a citizen's complaint. You can't start accusing people of crimes and have the cops start dealing out punishment without evidence.

I followed a drunk driver for about 10 miles. From city to county and then the dispatch said all 15 officers just got called to something else.(Most likely a shooting) She asked if I could identify the driver. I said no since it was at night and she informed me that they could do nothing without me being able to positively ID the driver.

So to apply that to this case: even if they could identify the rider, how can they prove that the rider was doing anything illegal?

i think they'd have to positively ID you, file a formal complaint, and have an affidavit made of their statement (essentially being under oath) - then the police could move on you; but you still have the oppertunity for a rebuttal (in court) assuming you can produce witnesses under oath as well

(i dabbled in a bit of legal stuff in H.S.)

What constitutes a positive ID? They see the rider and simply say, 'Yea, that's the guy'. Or would they have to describe the rider without seeing them, and the officers judge whether there is a correlation.

It just seems way too easy to pin somebody with something they didn't do.

Dude, stop doing wheelies on that road!!!

The last time we did a wheelie session the girl wrote down everyone's license plate, nothing happened. Unless they have video with you identified and your license plate, what's the point? It's your word vs. theirs.

I watched - WATCHED - my neighbors across the street run my mailbox over with their huge a$$ van (for, like, the 10th time). I ran out into the street, yelling & waving for them to stop, but they drove off. I wrote down the tag number and called the police. When the police showed up, he went to the neighbors house & knocked on the door to discuss the incident. The owner of the van said, "yeah, it's my van, but I loaned it out; I don't know who was driving it." I was like :wtf: So the officer asked if I could identify the driver of the van. I could not.

Even though I SAW the van do it, with my own 2 eyes, I couldn't specifically say WHO did it. So I had to buy a new mailbox later that day.:headshake

My point is, unless the person filing the complaint can positively ID the person who was doing the wheelie, then I don't see how it would go anywhere. If the rider had on a helmet, then a positive ID would be impossible.

Its called "hear say" and can be beaten easily in court, Unless the officer sees it and can verify it happened.......nothing can be done. He can call you and tell you what has been said, but thats about it.

When I was younger I bought a brand new Suzuki Samurai 4X4, It so happens I go over to my girlfriends, and on the way i see a stop sign laying in the middle of her street. So I stop, pick it up, and throw it in the back. Pick up the GF and head into town, stopping at the Hwy dept and drop off the sign and tell them where i found it, They say "thanks" and I leave. About an hour later my mother who works for the license dept calls me and says the cops just called and ran my plate number saying that my vehicle was seen driving through this ladies front yard hitting the stop sign and taking off with it. My mother recognizes the plate number he gives......"MY4X4" and explains to the officer that "this story cannot be true because It was my sons Suzuki and it is less than a week old and would not drive like that". So I drive over to the Cop shop without being asked and show them my suzuki...Not a scratch, After looking at it they realized the lady was Full of :poo: and some people are not happy unless they are stiring up :poo:

Moral of the story.......regardless of your good intentions, someone will find fault with it and try to get you in trouble for it.

i was riding with a buddy and he was weaving in and out of traffic and i was following. cop flys by us as we were exiting. i jump back on the highway and my friend gets pulled over. he gives the cop my first name and number so the cop doesnt give him a racing ticket which was B/s. i get a 1 call from the cop. i never pick up. end of story.

even if i had picked up it was IMPOSSIBLE for the cop to prove it was me. i had full gear so none of my skin was showing. dark tinted face shield. so in court he would be screwed which is why he never called again.

if the police to not see you do it, and you do not admit it, you will not get a ticket.

my partner flipped a wheelie in front of me. police came and a lady told them what was going on. the cop questioned me for a few minutes and said something to the effect of ' A witness said you guys were riding wheelies, were you riding wheelies? no-ooo. she was still on the scene and could positively identify us. no ticket was given because the cops did not see it.

a while back me and a buddy where driving home from the bar, i was driving his car cause he was wwaaaasted. so were driving down the e-way and this car starts to ride are ass, and just will not pass. so i slow down and make them pass. then they start to drive like 45 down the road, so i go to pass and they cut me off so i cant. eventually i get around them and my drunk buddy throws a beer bottle at them as i pass it hits there windshield and they pull over to the shoulder...we leave. two days later cops show up at his house askin if he was involved in a road rage incident... no sir ... end of story. they dont see it, never happened.

well, i will say this, from what i see you all have some straight up cops, because around here if somebodys makes a complaint, your gonna get a ticket, go to court and the judge is gonna laugh at you and your lawyer, because he makes the rules, unless you just have money to blow on an appeal, more than likely you are gonna get screwed, here say or not, if they have your tag # you are responsible for the actions of your vehicle.

Mikeb12 is 110% correct. I have a copule friends that have that effect on people. One rides stand ups all the time, and has had the cops over at least 12+ times because some one wrote down his plate. All he says is it wasn't him and keeps cool. The cop gets mads threatens him, then it's over, no ticket. If they don't see you in the act it's over.

wh@ if u saw some 1 speeding or something & called the cops with there plate # ? not much th@s wh@ ... just never admit 2 anything if "they" call u or come 2 c u :thumbup:

around here if a complaint is called in the cops wont do even respond till it gets called in two more times...i guess they are just lazy

generally, if you report speeding or a drunk driver or something, the cops care more about where you saw it so if an officer is in that area they can look for them. LP does not really matter unless its a hit and urn type thing where there is evidence. Speeding and wheelieing doesn't leave any evidence.

I know this is an old thread but I came across it and thought Id put in my .02 I was riding by an elementary school the other day and naturally all the kids all start running towards the fence to see the bike going by as soon as they see me come around the corner. so I pull a little wheelie... sell a few gsxrs to the next generation... any way as I set it down this old man starts running towards my bike like hes gonna try and tackle me off of it.... I blow by him and ride off.... anyway about 5 miles later a cop shows up behind me... pulls me over and starts goin off asking what the hell made me feel like I should wheelie past that school.... (this was in a really small town btw and you can see for like a mile around the school... there was no cop) so naturally I reply "what school" anyway what it all came down to was that the old man running at my bike was an off duty officer and called his buddy that was on duty to chase me down.... the cop said that if he had seen it I would have been goin to jail.. bike impouded.. yadda yadda... but its illegal to give me a ticket or anything without evidence.. in this case the on duty cop would have had to see me..... so ya...

you could have earned one easily,the offduty cop would have had to come to where you were pulled over at,and i.d. your face,since you left his sight.but he would have had to i.d. you onsite before citation.no,i'm not the popo!
i got an airplane ticket,showed up at court.pilot and i showed,issueing officer did not.i did not even have to oppose,pilot just said,i cannot identify the subject,the officer that wrote the citation is not here to i.d.,judge said DISMISSED.
KNOCK ON WOODY.the cop that wrote the ticket said he did not have the discretion to give me a warning,he said he did not want to cite me,but he was issueing for the pilot.no choise.

look its called hear say im a cop down here in south ga. if some one calls in the complaint we go check it out if i dont see it i cant do anything. we however can find the vehicle and follow it waitng for our own p.c. probable cause to pull u over. nonthing can be done about what some one else says .

The worst that can happen is you get a warning from the police station. Thats all.

Citizens can't ticket people, only police can.

You'd have to have a really really anal police department and city or district attourney that would be willing to charge you based off a citizen complaint (its not like you killed someone), plus your neighbor would need to have some pretty strong evidence.

Do a search, they started in some states where police departments are loaning out radar guns to neighbors and training them to track down speeds. The speeds can't get tickets based of citizen reports but can get a warning letter. Why to help "love thy neighbor."

Sooner or later, if you don't rat people out, the police is gonna come after you for not complying. Fuck that.

i think the cop has t oactually see you do the crime. just look at stunt videos there are tons of riders on tape doing wheelies and other illegal stuff on the roads. if that where the case they would all get tix just for releasing videos. also have you tried calling your local police station to se what the cops say themselves

Basically isn’t it the same as photo radar? If you have a helmet on they cant prove it was you, so no ticket.

More importantly why are people so worried about you riding a wheelie? WAAAAA!!!!

How F'in cares?!?! If you were stealing cars or raping little girls there's a concern that people should call the police. But you’re out enjoying your motorcycle. why don’t they leave you alone

Innocent until proven guilty. Proven implies proof.

If a tree falls in the forest and noone sees it, did it really happen?

A game warden pulls up to a man in a boat and notices several fish. He ask the man for his fishing license only to find out the man doesn't have one. "Well I'm going to have to give you a ticket for the fish" the warden sais.

"Oh officer let me explain" the man sais. "These are actually my pet fish" "I bring them out once a week to let them swim" the man sais. "Then I whistle and they come back"

The warden thinks to himself (I've got to see this)

The man take the fish, releases them, and they swim away. After a few minutes the game-warden says "OK now whistle and bring them back"
The man replies "Bring what back"
The warden say "The fish ofcourse"
And the man replies "what fish?"
